Terms of Use

The American Cancer Society, South Atlantic Division, Inc.’s (“ACS”) content delivery system is an information service offered by ACS at no charge to your company, with the express condition that you agree on behalf of your company to be bound by these terms and conditions set forth in this User Agreement. Use of the information provided at www.acsemployercontent.org (the “Content Page”) constitutes your acceptance of all of the following terms and conditions, in their current form or as modified.  ACS reserves the right to change these terms and conditions at any time, without notice to you.  You may consult the most recent version of this User Agreement by accessing the link provided on the Content Page.

License to Use Downloaded Materials and Other Content Provided

By downloading materials from the Content Page, you are agreeing on behalf of your company to abide by the following terms and conditions.  ACS is granting to your company a limited, non-exclusive, non-assignable, revocable license to utilize the copyrighted content supplied in the download and the ACS name and logo attached to the download (the “Materials”).  The Materials may only be used for distribution to your company’s employees.  You may not alter the Materials in any way except that you may include your company’s name and logo on the Materials and in the case of Materials that are provided in a format that may be altered, you may incorporate those Materials into other documents provided that the substance of the Material is not altered and you identify the American Cancer Society as the source of those Materials.  No third party logo or information may be added to the Materials without the prior written consent of ACS.

Limitation of Liability

You agree that you will hold harmless ACS and its officers, directors, employees, and volunteers from all claims arising out of or related to your access or use of, or your inability to access or use, this Content Page or the information contained in the Content Page or websites to which it is linked. This includes, but is not limited to, information or materials viewed or downloaded from the Content Page or another website to which it is linked that appear to you or are construed by you to be obscene, offensive, defamatory, or that infringe upon your intellectual property rights. In no event will ACS or the contributors of information to the Content Page be liable to you or anyone else for any decision made or action taken by you in reliance on such information or for any consequential, special or similar damages, even if advised of the possibility of such damages.

You acknowledge and agree that use of the information, tools and services provided on the Web Site www.cancer.org, even if you access Cancer.org via a link from the Content Page, is subject to the Cancer.org User Agreement, which you can find at www.cancer.org/docroot/SU/content/SU_1_1_User_Agreement.asp
